This Privacy Policy explains how Clearweather, LLC, doing business as Clearweather (“Clearweather,” “we,” “us,” or “our”) collects, uses, and discloses your personal information when you visit clearweatherbrand.com, make a purchase, create an account, sign up for email or text messages, contact us, or otherwise interact with our store and related services (the “Services”). Our store is powered by Shopify.

Where We Get Personal Information

For example, we use Shopify to support personalized advertising with third-party services based on your online activity with different merchants and websites. These partners use your information under their own privacy notices. Depending on where you live, you may have the right to direct us not to share your information for these purposes. • When you direct or ask us to, or otherwise consent, such as to ship you products or when you use social media widgets or login integrations.
• With our affiliates or within our corporate group.
• In connection with a business transaction such as a merger, sale of assets, or bankruptcy; to comply with legal obligations, including subpoenas and search warrants; to enforce our terms and policies; and to protect the Services, our rights, and the rights of our customers and others.

Text messaging: We do not share your mobile phone number, SMS opt-in data, or consent records with third parties or affiliates for their own marketing purposes. This information is shared only with the service providers that deliver our text messages.

Relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit may be transmitted to and shared with Shopify and third parties located in countries other than where you live. We also use certain Shopify enhanced features that draw on your interactions with our store, with other merchants, and with Shopify. For those features, Shopify is responsible for processing your personal information, including responding to requests to exercise your rights over that use. The Services may link to websites and platforms operated by third parties, such as our returns portal, package protection provider, payment providers, and social media. Information you share on public or semi-public platforms, including social networks, may be visible to other users. A link does not imply our endorsement of the third party.

Children's Data

The Services are not intended for children, and we do not knowingly collect personal information from children under the age of majority in your jurisdiction. If you are a parent or guardian and believe your child has given us personal information, contact us using the details below and we will delete it. We do not have actual knowledge that we “sell” or “share” (as those terms are defined in applicable law) the personal information of anyone under 16 years of age.

Security and Retention

We use administrative, technical, and physical safeguards designed to protect personal information, but no security measures are perfect, and information sent over the internet may not be secure in transit. Please do not send sensitive or confidential information to us through unsecured channels.

An opt-out made on the page applies to the browser and device you use, so you may need to repeat it on other browsers or devices or after clearing cookies.
• Managing communication preferences: you can unsubscribe from marketing emails using the link in any email, and stop marketing texts by replying STOP. We may still send non-promotional messages about your account or orders.

Global Privacy Control. If you visit our website with the Global Privacy Control (GPC) signal enabled, depending on where you live, we will automatically treat it as a request to opt out for that browser and device, and for your account if we can associate the device with it. Other than GPC, we do not respond to “Do Not Track” signals.

UK and European Economic Area residents, subject to local law, also have the right to object to or restrict our processing of personal information for certain purposes, and, where we rely on consent, to withdraw that consent at any time without affecting processing that took place before withdrawal.

California residents may also request information about our disclosure of personal information to third parties for their direct marketing purposes under California Civil Code Section 1798.83 (“Shine the Light”).

We will respond within the time required by applicable law.

If we decline your request, you may appeal by replying to our decision or emailing cs@clearweatherbrand.com with “Privacy Appeal” in the subject line. International Transfers

We are based in the United States and may transfer, store, and process your personal information outside the country where you live.
